Camera Surveillance Regulations – The NXT Fit B.V.

1. Nature of the Camera Surveillance

1.1. The NXT Fit B.V. uses camera surveillance for the purposes of:

• access control of buildings and premises of The NXT Fit B.V.,

• protection of goods present in buildings or on premises of The NXT Fit B.V.,

• prevention and recording of disturbances such as vandalism,

• monitoring of staff workplaces at The NXT Fit B.V.,

• prevention and recording of criminal offenses by third parties (such as burglary, theft, or vandalism),

• and all matters directly related to the above.

1.2. Recorded footage may be reviewed at any time.
1.3. The camera surveillance is announced via signage at the borders of the monitored areas, clearly displayed screens showing live footage, visibly mounted cameras, a notice on the bulletin board at The NXT Fit B.V., letters to those who may be recorded, or other clearly recognizable means as required by the situation.

2. Hidden Cameras

2.1. No hidden cameras are used.

3. Execution of Camera Surveillance

3.1. The camera surveillance is carried out in practice by The NXT Fit B.V. The NXT Fit B.V. retains full responsibility at all times for the execution of the surveillance.

4. Retention Period of Footage

4.1. Recorded footage is stored for five working days for the purposes mentioned under "Nature of the Camera Surveillance."

4.2. If an incident relating to the aforementioned purposes is visible in the footage, the relevant footage may be retained until the incident is resolved.

4.3. After the retention period or resolution of the incident, the footage is deleted by being overwritten with new recordings.

4.4. Upon request by an individual captured on the footage, and provided there is no longer a necessity under these regulations to retain the footage, it will be deleted.

5. Access and Security of Footage

5.1. The NXT Fit B.V. has taken adequate measures to prevent unauthorized access to or misuse of stored footage.

5.2. The room where the footage is stored is physically secured against unauthorized access (e.g., key, access card). The footage is stored on a separate, closed system not accessible via the network to anyone other than The NXT Fit B.V. Personnel authorized to view the footage are bound by confidentiality. Access is password-protected and only allowed under the “four-eyes principle” (two persons simultaneously).

6. Viewing and Copies of Footage

6.1. A person recorded on camera can request to view footage in which they are clearly visible by making an on-site request at The NXT Fit B.V.

6.2. A person recorded on camera can request a copy of the footage by submitting a written request to The NXT Fit B.V.

6.3. Such a request requires proof of identity and a clear indication of the time frame during which the individual suspects they were filmed.

6.4. A request may be denied if it is excessive or made shortly after a previous request.

6.5. No costs will be charged for handling access requests or for providing a single copy. Administrative costs may apply for additional copies.

7. Disclosure of Camera Footage

7.1. Recorded footage will only be disclosed to judicial authorities if a legally valid order from the Public Prosecutor is received or if another legal provision requires The NXT Fit B.V. to do so.

7.2. If footage contains evidence of criminal activity, The NXT Fit B.V. may decide to file a report and voluntarily hand over the footage to the competent authorities.

7.3. No footage will be disclosed to private parties, except when they themselves are recorded (see ‘Viewing and Copies’ above).

8. Complaints and Inquiries

8.1. Questions or complaints about the application of the camera system or conduct of involved personnel can be submitted directly to The NXT Fit B.V. Contact details:

8.2. A response will be provided within four weeks of receiving the complaint.

8.3. In cases not covered by these regulations, The NXT Fit B.V. will decide.
