Terms and Conditions – The NXT Fit

Article 1 – Information about The NXT Fit

Article 2 – Definitions

• Offer: All Products offered via the Website or Reception.

• Customer: Any (legal) person who purchases a Product, places an order/reservation, or submits a price inquiry to The NXT Fit.

• Reception: The location or QR code within The NXT Fit where entry tickets are sold.

• Agreement: The agreement between The NXT Fit and the Customer, governed by these terms and conditions.

• Products: Entry tickets, memberships, and other products offered by The NXT Fit.

• Regulations: The house rules that all visitors must comply with.

• Website: www.thenxtfit.com

Article 3 – Applicability

• These terms and conditions apply to every Offer and Agreement.

• They are made available to the Customer prior to the conclusion of the Agreement.

• Changes will be announced via the Website or Reception and are binding.

• The Customer’s own terms and conditions are not applicable.

Article 4 – Conclusion and Duration of the Agreement

• The Agreement is concluded upon acceptance of the Offer and terms and conditions.

• By making a purchase, the Customer also agrees to comply with the Regulations.

• The Agreement remains in force until all obligations, particularly payment obligations, have been fulfilled.

Article 5 – Prices

• Prices are stated on the Website or at the Reception and include VAT.

• Prices may be changed; changes will be communicated via the Website.

Article 6 – Payment

• Payment must be made at the time of ordering via the Website or at the Reception.

• Entry tickets are non-refundable; however, time slots can be rescheduled.

• Invoices for group visits must be paid within 15 days. In case of late payment, statutory interest will apply.

Article 7 – Entry Tickets and Memberships

• Strictly personal, non-transferable, and non-reproducible.

• Misuse will result in immediate cancellation without refund.

• Loss or theft must be reported immediately.

• Access is only valid for the reserved time slot; late arrival does not entitle the Customer to extended access.

• The NXT Fit reserves the right to change opening hours without compensation.

Article 8 – Account

• A personal account must be created online or on-site to access The NXT Fit.

Article 9 – Regulations and Safety Restrictions

• The Customer must comply with the Regulations; violation may result in denied access.

• Access to certain activities may be subject to safety restrictions such as age or height requirements.

Article 10 – Complaints

• Complaints can be submitted via info@thenxtfit.com.

Article 11 – Privacy and Media Usage

• The NXT Fit processes personal data in accordance with its privacy policy at www.thenxtfit.com/privacy-policy/.

• During visits, general photos and recordings may be made. Targeted images will only be taken with prior consent.

• Visitors who do not wish to appear in photos or recordings must notify the Reception before entering the location.

Article 12 – Applicable Law

• These terms and conditions are governed by Dutch law. Disputes shall be submitted to the competent court.

Article 13 – Miscellaneous

• Liability is limited to the value of the ordered Products.

• The invalidity of one provision does not affect the validity of the remaining provisions.
   

Article 14 – Accessibility
The NXT Fit experiences are designed for full body exercise and are therefore not fully suitable for visitors using a wheelchair or with a visual impairment. In the bar area, it is possible to watch and participate in the gaming experiences. Our team is happy to think along and provide support where possible. However, we cannot guarantee full accessibility for all activities.
